Whether we serve as the data controller or processor, Precision BioSciences has implemented numerous technical and organizational measures to ensure the protection of personal data processed through the Site. IV. PERSONAL INFORMATION WE SHARE

Precision BioSciences use Service Providers (Data Processors) who are third parties who provide services for us. Examples of these Data Processors include but are not limited to:

  • Our Contract Research Organization (CRO);
  • Our Clinical Trial Data Processors; and
  • Our IT Service Providers, such as website hosting, website analytics etc.

We have Data Processing Agreements in place with our Data Processors. This means that they cannot do anything with your personal data unless we have instructed them to do it. They will not share your Personal Data with any organization apart from us, or further sub-processors unless they also comply with our Data Processing Agreement. They will hold your Personal Data securely and retain it in accordance with our instructions and applicable law.

V. RETENTION

We retain a record of your Personal Data in order to provide you with a high quality and consistent service. Your data will always be handled in accordance with the Data Protection Legislation, and we will never retain it longer than is necessary.

For the purposes of this Website Privacy Notice, data relating to your use of this website will be retained for a period of 24 months. After this period, Precision will instruct the website host to securely deleted or anonymise such data.

VI. YOUR CHOICES

A. Information You Provide

You can always choose whether or not to provide information on the Site. However, if you choose not to disclose certain information, you may not be able to register as a user of the Site, which may limit your access to certain portions of the Site.

B. Communications From Us

Precision BioSciences may contact you by equivalently secure registered third-party platforms, email, telephone call, or SMS text. We will never contact you via any social media channel.

C. Your Rights and Your Personal Data

Unless subject to an exemption under the GDPR, if your personal data is subject to the GDPR, you have the following rights with respect to your personal data:

  • The right to request a copy of your personal data which Precision BioSciences holds about you. Where requested we will provide it to you free of charge and aim to do so within one month from when your identity is confirmed
  • The right to be informed about the collection and use of your personal data. We ensure we do this with our Privacy Notices (including this document). These are regularly reviewed and updated to ensure they accurately reflect our processing activities.
  • The right to request that Precision BioSciences correct any personal data if it is found to be inaccurate or out of date;
  • The right to request your personal data be erased where it is no longer necessary for Precision BioSciences to retain such data;
  • The right to withdraw your consent to the processing of personal data to which you earlier provided consent for processing;
  • The right to request that Precision BioSciences provide you with an export of your personal data and where possible, to transmit that data directly to another data controller (known as the right to data portability);
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction be placed on further processing;
  • The right to object to the processing of personal data (where applicable); and
  • The right to lodge a complaint with a data supervisory authority.

D. Transfer of Data Abroad

If your personal data is subject to the GDPR; Precision BioSciences may transfer your personal data out of the UK or EU to countries deemed by the ICO or European Commission (as relevant) to provide an adequate level of Personal Data Protection.   Where we transfer your personal data out of the UK or EU to countries not deemed by the ICO or European Commission (as relevant) to provide an adequate level of Personal Data Protection, Precision BioSciences will ensure the transfer has additional safeguards that allow us to conduct the transfer in accordance with the Data Protection legislation, such as the International Data Transfer Agreement, Standard Contractual Clauses, or relevant certifications (such as the EU-U.S DPF) to provide an adequate level of protection.

VII. A SPECIAL NOTE ABOUT CHILDREN AND CALIFORNIA RESIDENTS

Children are not eligible to use the Site, and we ask that minors (children under the age of 16) not use the Site, or submit any personal information through any of the Site’s features. If you are a minor, you can use the Site only in conjunction with your parents or legal guardians.

Precision BioSciences does not knowingly collect personal information from minors. If we become aware that we have collected or received personal information from a minor, we will delete that personal information.

If you are a California resident, you have the right, pursuant to Section 1798.83 of the California Civil Code, to receive once a year, free of charge: (1) information identifying each third party company to whom we may have disclosed, within the past year, personal information pertaining to you for that company’s direct marketing purposes; and (2) a description of the categories of personal information disclosed to that third party company in the immediately preceding calendar year. Please be aware that we are not responsible for the privacy practices of such other websites, and we are not liable for their misuse of personal information about you.

X. SPECIAL ADMONITIONS FOR INTERNATIONAL USE

The Site is hosted in the United States. All matters relating to the Site are governed exclusively by the laws of the State of North Carolina in the United States of America and not the jurisdiction in which you are located. If you are located outside of the United States of America and you contact us, please be advised that any information you provide to us will be transferred to the United States of America and that by submitting information, you explicitly authorize such transfer.

We may change or update the Site or any of our policies and procedures without prior notice, except that if any changes are likely to have an adverse impact on your rights under data protection law, we will use reasonable efforts to notify you of the changes in advance in writing or by post mail, and, where required, obtain your consent to our activities.
